Orange County's health commissioner said Monday that the Hasidic schools serving roughly 15,000 children in and around
Kiryas Joel must remain closed because of continued concerns about a spike in coronavirus cases and the schools' failure to report infections or comply with other state and county orders. Dr. Irina Gelman had ordered the schools to stay shut for at least two weeks on Oct. 5 pending a further determination, which meant she could have allowed them to reopen as soon as Tuesday. But she cited several factors to continue the closure in a statement to the Times Herald-Record on Monday, with no indication how long that could last. Gelman said the community's religious schools have failed to report coronavirus infections among students and staff to state officials for use on a state website that tracks those figures for every school in New York. She also said that many Kiryas Joel schools opened in spite of her order, "thus continuing to allow the virus to spread," and were failing to require masks or practice social distancing when inspectors visited them. Gelman said she also has asked the state to require doctors to report how many patients they see each day who have COVID-19 symptoms but decline to be tested, as medical providers in the Kiryas Joel and Monroe areas have told her office that some patients have done. She said refusing tests "artificially skews the data" on the prevalence of the virus. "The data is only valid when it is accurately reported and if people are being tested," Gelman said. Gelman noted that Kiryas Joel's public school, which serves about 250 special-education students and provides busing for the religious schools, will no longer be bound by her closure order because it has stayed shut, requires masks and distancing when it does operate and reports its COVID-19 data to the state. Gov. Andrew Cuomo also ordered Kiryas Joel schools to close two weeks ago as part of a broader set of restrictions that applied to virus "red zones" in Orange and Rockland counties and New York City and that required schools and nonessential businesses to close and limited attendance at houses of worship. Several Orthodox congregations are challenging those restrictions in federal court as discriminatory. Asked Monday whether the Orange County health commissioner or state officials ultimately will determine when Kiryas Joel schools may reopen, Jill Montag, a spokeswoman for the state Department of Health, said, "the state is the only entity that can order schools closed and/or to reopen." Orange County officials issued cease and desist letters last week to three Hasidic schools in Kiryas Joel and Monroe that they said continued to operate. On Friday, Gelman and Dr. Howard Zucker, the state health commissioner, filed a lawsuit to force one of those schools to close. Cuomo's office reported on Sunday that the average rate of positive COVID-19 tests in Kiryas Joel over the last seven days was 4.62%, a sharp dropoff from the 12.41% average over the seven days before that. The positive rate in Kiryas Joel was only 1.35% on Sunday, and just 13 confirmed coronavirus cases were reported in all of Orange County that day. Yossi Gestetner, co-founder of the Orthodox Jewish Public Affairs Council, an Orthodox advocacy group, questioned the continued school closure on Monday, saying Kiryas Joel's positive rate had dropped below the state's 3 percent baseline for red zones. "Clearly, more people are following the rules than what the commissioner suggests, and with numbers moving into comfort zone talk should be how to open schools soon; not to extend shutdown orders," he said in an emailed statement. "These unilateral extensions - in the face of good data - drive frustration and is unfair to students.”
